Terms of Service

Welcome to Nourish. These Terms of Service ("Terms") govern your use of thenourish.community (the "Site"), our coaching services, the Nourish Community membership, the Nourish Podcast, and any related services we offer (collectively, the "Services").
By using the Services, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Services.
Nourish ("Nourish," "we," "our," or "us") is operated by Nourish LLC, based in MD, USA.
1. Who can use the Services
You must be at least 18 years old to create an account, book coaching, or purchase a Nourish Community membership. By using the Services, you confirm that you are 18 or older and legally able to enter into these Terms.
If you're using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Accounts
Some Services — including the Nourish Community — require an account. When you create one:
You agree to provide accurate, current information.
You're responsible for keeping your login credentials confidential.
You're responsible for all activity that happens under your account.
You agree to notify us immediately at Lin@nourish.art if you suspect unauthorized use of your account.
We may suspend or terminate accounts that violate these Terms (see Section 11, below).
3. Coaching services
Nourish offers 1:1 coaching sessions with our team of coaches, booked through our Acuity Scheduling integration.
What coaching is
Our coaches work with filmmakers on career transitions, creative direction, burnout recovery, goal-setting, values alignment, and professional wellbeing. Sessions are conversations — we listen, ask questions, and help you think through your own decisions.
What coaching is not
Coaching is not medical, psychological, psychiatric, or therapeutic care. Our coaches are not licensed therapists, counselors, physicians, or mental-health professionals (except where expressly noted on a specific coach's bio, and only to the extent of that licensure).
Coaching does not diagnose, treat, or prevent any medical or mental-health condition.
Coaching is not a substitute for professional medical, mental-health, legal, financial, or career-placement services.
If you are experiencing a mental-health crisis, a medical emergency, or suicidal thoughts, please contact emergency services or a crisis hotline immediately. In the US, call or text 988 (the Suicide & Crisis Lifeline). Outside the US, contact your local emergency number.
No guaranteed outcomes
We'll show up fully and offer our best thinking. We cannot guarantee that coaching will produce any specific outcome — career change, employment, creative breakthrough, income change, or otherwise. What you take from coaching depends on many factors outside our control, including your own effort, circumstances, and the film industry as a whole.
Booking, cancellation, and no-shows
Session times, prices, and availability are shown at the point of booking via Acuity.
You can reschedule or cancel a session up to [ 24 ] hours before the scheduled start time at no charge.
Cancellations inside [ 24 ] hours, or no-shows, may be charged the full session fee at our discretion.
If we need to cancel a session, we'll offer you either a rescheduled time or a full refund of that session's fee.
Confidentiality
Session content is kept confidential between you and your coach, except:
Where disclosure is required by law (subpoena, court order, or mandatory reporting obligations such as threats of harm to self or others, or abuse of a child or vulnerable adult).
Where you've asked us to share notes with a third party.
Where we share de-identified, aggregated information for internal quality-improvement purposes.
4. Nourish Community membership
The Nourish Community is a paid private space for filmmakers.
Free trial
We offer a 2-week free trial with full access to the Community. You won't be charged during the trial. At the end of the trial, your membership will automatically convert to a paid subscription at the plan you selected, unless you cancel before the trial ends.
Pricing and billing
Annual plan: $125 / year
Prices are in US dollars. Applicable taxes (if any) are added at checkout.
Payments are processed by Stripe through Mighty Networks. By providing payment information, you authorize us to charge the payment method on file on a recurring basis according to the plan you selected.
Auto-renewal
Memberships renew automatically at the end of each billing cycle at the then-current rate. We'll charge the payment method on file unless you cancel first. We'll email you a receipt after each renewal.
Cancellation
You can cancel at any time from your account settings. Your cancellation takes effect at the end of the current billing cycle — you keep access until then. We don't pro-rate partial months or years.
Refunds
Coaching sessions: see Section 3.
Annual Plans: We may issue discretionary refunds for billing errors or exceptional circumstances. Email Lin@nourish.art to request one.
Community conduct
The Community only works because its members make it safe. By participating, you agree to:
Be respectful. No harassment, hate speech, discrimination, doxxing, threats, or sustained incivility.
Keep it confidential. What members share inside the Community stays inside the Community. Don't screenshot, quote, or repost another member's words outside the Community without their explicit permission.
Don't solicit. No cold-pitching services, scraping members for leads, MLM recruiting, or spamming the feed.
Bring real identity. Use your real name and professional identity. Don't impersonate other people.
No illegal content. Don't post content that infringes copyright, violates trade secrets, exposes confidential information you don't have the right to share, or that's otherwise unlawful.
We may warn, suspend, or permanently remove members who violate these rules, at our discretion. In serious cases (harassment, threats, illegal content), we may remove a member immediately without refund.
5. Podcast, newsletter, and free resources
Some of our content — the Nourish Podcast, the newsletter, and any "Resources" articles on the Site — is free to access. You don't need an account to enjoy this content.
These Terms apply to your use of that content. In particular, the intellectual-property and conduct sections below apply regardless of whether you've paid for anything.
6. Intellectual property
Our content
All content on the Site and in the Services — including the Nourish Podcast, written resources, coaching frameworks, branding, logos, photography, and software — is owned by Nourish or our licensors and is protected by copyright, trademark, and other laws.
You may:
View, download, and share publicly available content (podcast episodes, blog posts) for your own non-commercial use.
Link to our content with attribution.
You may not:
Copy, modify, redistribute, or commercialize our content without written permission.
Remove copyright, trademark, or attribution notices.
Scrape the Site or use our content to train machine-learning models without our explicit consent.
Your content
When you post content inside the Nourish Community, submit content through a form, or otherwise share material with us ("Your Content"):
You keep ownership of Your Content.
You grant Nourish a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and share Your Content within the Services, only as needed to operate the Services.
You grant other Community members a limited license to view Your Content inside the Community.
You represent that you have the right to share Your Content and that it doesn't infringe anyone else's rights.
We may remove Your Content if it violates these Terms, is the subject of a valid legal complaint, or otherwise puts the Services at risk.
7. Third-party services
The Services integrate with several third-party providers:
Squarespace — hosting, commerce, account management.
Squarespace Payments / Stripe — payment processing.
Acuity Scheduling — session booking.
Flodesk — newsletter and email marketing.
Podcast platforms (Apple, Spotify, Pod.link) — podcast distribution.
Your use of these third parties is also governed by their own terms and privacy policies. We're not responsible for the acts or omissions of third parties.
8. Prohibited uses
You agree not to:
Use the Services for any unlawful purpose or in violation of any applicable law.
Attempt to access another user's account, payment details, or private Community content without authorization.
Probe, scan, or test the security of the Services or attempt to breach authentication or access controls.
Interfere with or disrupt the Services (denial-of-service attacks, flooding, etc.).
Use bots, crawlers, scrapers, or automated tools to extract data from the Services (except for standard search-engine indexing).
Reverse-engineer or attempt to extract the source code of the Services.
Impersonate any person or entity, or falsely state or misrepresent your affiliation with anyone.
Upload viruses, malware, or any other malicious code.
Use the Services to harass, threaten, or harm other users.
9. Disclaimers
The Services are provided "as is" and "as available," without warranties of any kind. To the fullest extent permitted by law, Nourish disclaims all warranties — express, implied, statutory, or otherwise — including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
We don't warrant that:
The Services will be uninterrupted, error-free, or secure.
Any content or information available through the Services is accurate, complete, or current.
Any outcome, result, or benefit will follow from your use of the Services.
Some jurisdictions don't allow the exclusion of certain warranties. In those jurisdictions, the exclusions above apply to the fullest extent permitted.
10. Limitation of liability
To the fullest extent permitted by law, Nourish and its owners, employees, contractors, and coaches will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, loss of goodwill, business interruption, or personal injury — arising out of or related to the Services, whether based in contract, tort, negligence, strict liability, or any other legal theory, even if we've been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising out of or related to the Services is limited to the greater of: (a) the amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) one hundred US dollars ($100).
Some jurisdictions don't allow limitations of liability for certain damages. In those jurisdictions, our liability is limited to the fullest extent permitted.
11. Termination
You can stop using the Services and cancel your account at any time via your account settings or by emailing Lin@nourish.art.
We can suspend or terminate your access to the Services — in whole or in part, with or without notice — if:
You violate these Terms.
You engage in conduct that harms other users, our coaches, or the Services.
We're required to do so by law.
We decide to discontinue the Services (in which case we'll give reasonable notice and pro-rated refunds where applicable).
Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Dispute Resolution) will survive.
12. Indemnification
You agree to indemnify, defend, and hold harmless Nourish and its owners, employees, contractors, and coaches from any claim, liability, damages, or expense (including reasonable attorneys' fees) arising out of:
Your use of the Services.
Your violation of these Terms.
Your violation of another party's rights (including intellectual-property rights).
Your Content.
13. Dispute resolution
Informal resolution first
Before filing a formal claim, please contact us at Lin@nourish.art with a description of the issue. We'll try in good faith to resolve it within 30 days.
Governing law
These Terms are governed by the laws of the MD, USA, without regard to conflict-of-laws principles.
Venue
Any dispute that isn't resolved informally will be handled in the state or federal courts located in MD, USA, and you consent to personal jurisdiction there.
No class actions
You and Nourish both agree that any dispute will be resolved on an individual basis. Class-action lawsuits, class-wide arbitrations, and representative actions are not permitted.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we'll update the "Effective date" at the top and, for material changes, notify you by email or a banner on the Site at least 14 days before the changes take effect. Continued use of the Services after the changes take effect means you accept the updated Terms.
15. Miscellaneous
Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and Nourish regarding the Services.
Severability. If any provision is found unenforceable, the rest remains in effect.
No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
No assignment. You may not assign these Terms. We may assign them to a successor entity (e.g. in a merger or sale).
Notices. We'll send legal notices to the email associated with your account. You'll send notices to Lin@nourish.art.
Relationship. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Nourish.
